These terms apply to artists who exhibit in the Ballroom of the Residence of Baroness Swan, the virtual 3D gallery at lanaswan.com/virtual-gallery. The gallery is run by Svetlana Shavrina, working as Lana Swan, London, United Kingdom (“Lana Swan”, “we”). “You” means the artist who applies.
This is a public offer. You accept these terms by submitting the application form and by paying the invoice for your place.
1. Applying and review
1.1. Applying is free. You send images of your works and their details through the form on the Exhibit in the Ballroom page.
1.2. Lana Swan reviews every application and replies within 5 working days. She decides which works fit the exhibition and may accept some works, all of them or none, without giving a reason.
1.3. Nothing is payable until your works are accepted.
2. Fees and payment
2.1. The fees are listed on the Exhibit in the Ballroom page: £20 for one artwork, £40 for two or three artworks, £60 for the Featured option. Each fee covers one exhibition for its whole period, as shown in the exhibition calendar. Most exhibitions run for one calendar month; some run longer.
2.2. After acceptance you receive a link to pay online by email. Please pay within 7 days. Your place is confirmed once the payment is received. If the payment is not made in time, the place may be offered to another artist.
2.3. Your works are hung within 3 days of payment.
2.4. Once your works are on display, the fee is not refundable. If we cannot show your works for reasons on our side, we refund the fee in full or for the part of the period that was missed.
3. Permission to display your works
3.1. You keep all copyright in your works. Nothing in these terms transfers ownership of your works or their copyright.
3.2. You give Lana Swan a non-exclusive, free, worldwide permission to show the images and details you send: in the virtual gallery and on the exhibition pages of lanaswan.com during the exhibition, and in posts and newsletters that promote the exhibition.
3.3. After the exhibition your works may stay in the archive of past exhibitions on lanaswan.com. If you would like them removed, write to us and we will remove them within 14 days. Social media posts already published may stay online.
3.4. For display, images may be resized, cropped to fit a frame, framed and lit in the style of the gallery. The works themselves are not altered.
4. Your guarantees
4.1. You confirm that you are the author of the works, or that you hold all the rights needed to show them, and that the images and texts you send do not infringe anyone else’s rights.
4.2. You confirm that the works contain nothing unlawful. Lana Swan may remove any work from the gallery if a complaint about rights or content is received, and will contact you about it.
4.3. If a claim is made against Lana Swan because a work you sent infringes someone else’s rights, you are responsible for that claim.
5. Links and sales
5.1. Each of your works has a card in the gallery with a link to your website, Instagram or shop.
5.2. Sales made through your own link are between you and the buyer. Lana Swan takes no commission on them and is not a party to them.
6. Selling through the Lana Swan shop (optional)
6.1. If you ask for it in the form, and Lana Swan agrees, a work may also be listed for sale in the Lana Swan shop on lanaswan.com.
6.2. For every work sold through the shop, a commission of 25% of the sale price, not counting delivery, is taken. You receive the remaining 75% within 14 days after the buyer’s payment is received and the return period has ended.
6.3. The price, edition, delivery and who ships the work are agreed with you in writing before the work is listed.
7. Placement
7.1. Lana Swan decides where each work hangs in the Ballroom, except for the Featured option, which includes the best spot of the hall.
8. Liability
8.1. The exhibition is virtual, so no physical works are sent or handled.
8.2. We take care to keep the gallery online, but we cannot promise that it will be available without interruption. We are not responsible for copies of your images made by third parties.
8.3. Our total liability to you is limited to the fee you paid for the exhibition.
9. Your personal data
9.1. We use your name, email and the details you send only to review your application, to run the exhibition and to contact you about it. Your name, link and works are shown publicly in the gallery. We do not sell your data. You can ask us to delete it at any time.
10. Law
10.1. These terms are governed by the law of England and Wales.
